When you purchase a building lot in Southwest Florida you should be aware that the U.S. Fish & Wildlife Service regulates development on land inhabited by protected or endangered species. Among those in our area is the Florida Scrub Jay. Building lots in Englewood, Gulf Cove and Deep Creek are some of the neighborhoods most affected by Scrub Jay protected areas. To make it easy to find out if your lot is on the list of lots in the scrub jay protected zone, Charlotte County now has a list of lots on the county website. Click this link to check if your lot is in a Scrub Jay protection zone in Charlotte County. The City of North Port has a list of Scrub Jay zone lots on their website. Download the North Port list in pdf form by visiting this site. For the remainder of Sarasota County call (941) 861-6232 and ask for information regarding your property. List of environmental consultants performing Scrub Jay studies If your lot is in that zone you will be subject to review by the USFWS. To begin the application for review you must complete a Scrub Jay Review Package and submit it to the agency. By clicking the link above you will download the forms need for submission of your lot. Scrub Jay protection zones are constantly changing. Birds move around and they can relocate to a previously unregulated area. It is illegal to disturb nesting Scrub Jays, their nests or eggs. It is illegal to develop or clear land in a Scrub Jay protection zone. Scrub Jays do not nest on cleared land. They only nest in scrub oak. If you purchase property in an area that is not in a Scrub Jay protection zone, it is highly recommended that you clear the lot of brush and scrub as soon as possible. While Scrub Jays can change their location at any time, lots for sale in Rotonda, Florida have had little impact at this writing.
